Komisja Nadzoru FinasowegoThe Supreme Court judgment in the matter of cassation filed by MCI Management S.A. against the State Treasury– pertaining to the case of JTT Computer S.A.

The management of MCI Management S.A. informs, that on 23rd November 2012, a court hearing shall be held in the Appellate Court in Wroclaw filed by MCI Management S.A. against the State Treasury – Director of the Treasury Control Office in Wroclaw – a suit for payment of damages connected to the bankruptcy of JTT Computer S.A.
The case mentioned above was established with regard to the fact that the Supreme Court revoked the judgment of the Appellate Court In Wrocław awarding MCI Management S.A damages from the State Treasury – Director of the Treasury Control Office in Wroclaw in the amount of 28.904.888,00 PLN along with statutory interest accrued from 8th June 2006 till the date of payment.
The Supreme Court indicated in the said judgment that the basic charge of the State Treasury – Director of the Treasury Control Office in Wroclaw represented by the State Treasury Solicitor’s Office is the fact of questioning the legal capability to bring the action to court by MCI Management S.A. as lacking justification. The Supreme Court confirmed that, in principle, there is a legal basis to file such claim. The judgment regarding the amount of damages awarded to MCI Management S.A. was left to the Appellate Court in Wroclaw for review.
