RB nr 9/2010

Management Board of MCI Management SA informs that on March 15, 2010 the Circuit Court in Wrocław Civil Division I in the case brought by MCI against the State Treasury – Director of the Tax Audit Office in Wrocław (file ref. no.: I C 1004/06) awarded the amount of PLN 38,512,000 to be paid to the Company by the State Treasury with statutory interest from June 8, 2006 until the date of payment (as of the date of the announcement of the decision the interest amounted to PLN 17,429,000.) The decision is not final and it can be appealed.

The due amount was awarded as damages for the loss incurred in connection with the loss of value of the shares held by MCI Management S.A. in JTT Computer S.A. which went bankrupt as a result of erroneous decisions made by tax authorities in violation of law.
Thus the Court shared in full the position of the Company described in the claim and presented during the trial in respect of both the principle and the amount of the claim.

However, the Management Board of MCI Management SA Gould would like to note that the decision which was issued in the first instance is not final. This should be taken into account by present and future investors – shareholders of the Company.
